HCST*Net Network Service Terms and Condition

Outline

The following describes the terms and conditions for HCST*Net Internet services. Use of HCST*Net services indicates acceptance of these terms. HCST*Net reserves the right to modify the Policy at any time, effective upon posting at http://www.hcst.net/legal/netterms.htm. "HCST", and "HCST*Net" refer to services provided by Hassler Communication Systems Technology, Inc.

Rules of Operation, Terms and Conditions

HCST will provide access to HCST*Net Internet services (the “Service”) in exchange for payment of fees and compliance with the rules of operation, terms and conditions of this agreement.

The Customer agrees to the following:

Service Fees

HCST will send a monthly invoice for requested services. Recurring charges for HCST*Net services are billed in advance. Payment is due upon receipt of an invoice, and must be received by HCST no later than 15 days after invoice date. An account 30 days past due may be terminated without additional notice. Recurring services may be prepaid, but no refunds can be provided for services discontinued prior to the end of the prepayment period.

Customer will be charged $20 per check returned unpaid and the outstanding balance will be considered unpaid.

HCST shall make reasonable effort to maintain uninterrupted services. However, any interruption of service does not relieve the Customer from the obligation to pay monthly fees.

Should the Customer's access to the Service be terminated for any reason, all fees received by HCST shall be forfeited as liquidated damages.

Customer is liable for monthly service fees until request to terminate services is received by HCST in writing or via Electronic Mail to billing@hcst.com.

Service Commitment

HCST*Net dedicated Internet (Digital Subscriber Loop, Wireless and T1) services require service commitments in one year increments, unless otherwise negotiated. Cancellation of services prior to the end of the service commitment may result in cancellation penalties. Details on cancellation penalties will be provided upon request.

Request for termination of dedicated Internet services must be provided in writing to HCST with a minimum of 30 days notice.

Rules Compliance

The Customer agrees to comply with the HCST*Net Acceptable Use Policy, available on the HCST*Net web site (http://www.hcst.net/legal/aup.htm) and incorporated herein by reference.

Lawful Use

The Customer agrees to use the Service in a manner permitted by applicable local, state, and federal laws.

The Customer shall not utilize the Service for any illegal activity or place any information (text, data, graphics, etc.) on the Service in any form which is related to illegal activity or is scandalous, defamatory, obscene, immoral or in violation of another’s rights, including, but not limited to, copyrights, trade secrets and privacy.

The Customer understands and agrees that unauthorized use of any computer network is illegal and may be punishable by fines and/or imprisonment under Ohio and federal laws.

Service Information

The Customer understands and agrees that HCST is not responsible for monitoring the content of information placed on, or obtained through the Service; nevertheless, HCST reserves the right to remove any information conflicting with HCST's business, considered unacceptable by HCST, or otherwise in violation of this agreement.

The Customer understands and agrees that HCST has no obligation to preserve or protect any rights which the Customer may have in any information placed on the Service.

HCST makes no representation nor warranty regarding the quality, accuracy, or validity of data or information residing on or passing through any networks, including HCST*Net.

Use of any information obtained through HCST*Net services will be at the Customer’s own risk.

HCST and its providers do not represent or warrant that access to the Service shall be uninterrupted, or that there shall be no failures, errors, omissions, or loss in the transmission of information.

Liability

HCST and its providers are not liable to Customer for any claims based on copyright, trade secrets or other property rights in regard to any information or the use to which any information is put by the Customer.

The Customer agrees to indemnify and hold harmless HCST and its providers from and against any claim, liabilities, losses, costs, damages, or expenses including attorney fees arising from the Customer's use of the Service.

This Agreement

The Customer may not assign or transfer, in whole or in part, this agreement or its rights to use the Service without the prior written consent of HCST.

This agreement shall be governed and construed in accordance with the laws of the State of Ohio.
